CHAPTER XII: UNFAIR LABOUR PRACTICES
Section 84: Prohibition of unfair labour practice
This section lays down a blanket rule forbidding both employers and workers/unions from engaging in specified illegal activities.
- Legal Text: “No employer or worker or a Trade Union, whether registered under this Code, or not, shall commit any unfair labour practice specified in the Second Schedule.”
- Simple English: It is strictly illegal for any company, individual worker, or union (even an unregistered one) to carry out any of the unfair practices listed in the Second Schedule of this Code (e.g., victimizing a worker, or striking illegally).
- Example: If a union insists that a non-union worker must be physically blocked from entering the workplace, they are committing an unfair labour practice as defined in the Second Schedule, and can be penalized.
